... has ruled that commercial property insurers who covered the World Trade Centre can pursue subrogation claims associated with losses stemming from the terrorist attacks of September 11 2001. The judge denied three motions from plaintiffs affiliated to Larry Silverstein, a group of airlines, and others. They argued that New York’s collateral source law barred such subrogation claims. Judge Hellerstein said that he found no such legislative intent to bar subrogation, which was a principle “embedded in the common law”.
